Domestic Employment Contract

Print E-mail

If your domestic worker (cleaner, nanny, gardener, cook, driver, etc) works for you more than 24 hours a month, you must have a written contract, and your worker must be given a copy. This contract should cover the following:

  • Commencement date and provisions for termination
  • Job description
  • Working days and hours
  • Salary and overtime pay
  • Annual and sick leave
  • Accommodation (if your domestic worker stays at your premises)
If you use an employment agency to find your domestic worker, they will provide you with a draft of contract and make sure that you as well as your domestic worker fully understand the meaning of all clauses.

Alternatively, download a sample of domestic worker employment contract, sample of job description and basic employment guidelines set by South African Department of Labour here.
